Noel Francisco could play role in future of nationwide sports betting

A Filipino-American lawyer was nominated by US President Donald Trump to be his Solicitor General before the Supreme Court.

Noel Francisco, a former partner Jones Day partner, was nominated solicitor general Wednesday morning. At Jones Day he worked with Donald McGahn, the current White House counsel, and is one of several Jones Day alumni now serving in the Trump administration.

Francisco was named principal deputy solicitor general in January, days after Trump's inauguration.

Francisco, who has been serving in an acting capacity in the job, is a lawyer with strong conservative credentials who previously worked at the Jones Day law firm.

It is hard to overstate the importance of the solicitor general's role in conducting the business of the high court. His credentials include arguing three high-profile cases before the Supreme Court.

A former law clerk to the late Justice Antonin Scalia, Francisco brings with him a wealth of appellate experience. He represented former Virginia Gov.

The role of Solicitor General doesn't usually make too many headlines, but that's nearly certain to change in the next four years. The court in June ruled 8-0 in favor of McDonnell.

Between 2003 and 2005, he served as deputy assistant attorney general in the US Department of Justice's Office of Legal Counsel.

In May, Francisco represented religious nonprofits seeking exemption from a provision in ObamaCare that required employers to pay for the contraception coverage. Additionally, Francisco worked in the Office of Counsel to the President as Associate Counsel during the George W. Bush administration. That case was sent back to a lower court in May 2016, in hopes the parties could reach a compromise.

In the third case, Francisco led a business industry-led challenge to presidential appointment powers, resulting in a 2014 ruling that limited the ability of the White House to fill positions without Senate approval. Less clear is why this position requires Senate confirmation at all.
